HR and Social Security Ministry, Finance Ministry and National General Taxation Bureau jointly issued the Notification on Active Actions to Relieve Company Burden and Stabilize Employment days ago, to raise the following 5 important measures:
Ⅰ
. Allow difficult companies to delay the payment of social insurance for no longer than 6 months within 2009. Employee social insurance will not be influenced and the payment years shall be calculated continuously during the delay.
Ⅱ
. Decrease fees for 4 social insurances in period. In the premise of ensuring unchanging benefit for the insured and avoiding deficiency, fees for basic medical insurance, unemployment insurance, work-related injury insurance and
maternity insurance can be lowered appropriately in 2009, but the period shall not be longer than 12 months. The notification also requires that all areas are now allowed to reduce the endowment insurance fee without permission.
Ⅲ
. Use the employment insurance fund to help difficult companies stabilize employment. Those areas that have sufficient amount of unemployment insurance fund, on the premise that the unemployment insurance benefit can be full paid at present and for a certain period of time in future, can be a trial area for using the unemployment insurance fund for more purposes. Namely, use the unemployment insurance fund to pay for social insurance subsidy and position subsidy. The implementation shall be within 2009, and subsidy period shall not be over 6 months.

. Encourage difficult companies to develop in-house trainings for employees.
Ⅴ
. Properly solve the problem of economic compensation in difficult companies. For those that have to lay off people though efforts have been made can sign an agreement for economic compensation payment in periods or other ways after discussing with the labor union or the staff according to the laws. The Notification also stipulates the conditions and recognition procedures for “Difficult Company", and requires local government and related departments to evaluate carefully, and detailed implementation measures shall be established based on sufficient evidences so as to ensure the good effect of the policy.
According to the Notification, “Difficult Company” shall comply with the following 4 conditions: 1. Have temporary influences on operation by the economic crisis, but are still hopeful to recover. 2. Have made employment preferential policies and no lay-off or only have small quantity of lay-off. 3. The business complies with the national and local industries and environment protection policies (excluding those limited by the country). 4. Have paid social insurance based on laws and regulations.
